Disorderly Conduct. Disorderly conduct is one of the least serious charges that one can face. Often, the DA will offer that you plea to disorderly conduct as a bargain that allows you to plea down from a more serious charge. That said, a conviction for disorderly conduct goes on your record. It will take at least five years before you can get it expunged. Know Your Defenses It is not unusual for police to abuse their authority by using a charge for disorderly conduct as a "catch all" for any conduct that the officer finds subjectively offensive. In many instances, the courts will dismiss a claim for disorderly conduct that is too speculative. You Have Rights The First Amendment prevents the prosecutor from prosecuting you for matters that relate to free speech or acts of personal expression. For example, you can use the "F" word to a police officer. Likewise, charges brought against you on the recommendation of another private citizen (such as a neighbor) may not result in a conviction if you stand up for your rights and show that you may appeal the district justice (magistrate) decision.
